Abstract

 

PERSONAL FREEDOM AND ITS POSSIBLE CONSTRAINTS IN FAVOR OF NATIONAL SECURITY

The aim of the present contribution Personal freedom and its possible constraints in favor of national security is to offer a systematic explanation of the right to personal liberty and its place within the system of rights and freedoms. The fundamental part of the article deals with the state guarantees when applying the norms of public law, but particularly the criminal law in relation to a free human-being is dealt with. Besides that the attention is given to the legal adjustment concerning health care, through which personal liberty may be abridged if it is provided without the consent of a free and liberated individual.
